PiP - Hayward Toyota dealer demanding $595 over negotiated pre-order price

    Hi all,
    I just got a call from the dealer that my PiP would be available on thursday next week. I originally got $1000+ off MSRP in my negotiated price.

    Negotiated Price - $ 31,906

    MSRP - $32,925 ($32,000+ 225 (mats) + 760 (destination))

    However, they are now saying that they got the following unexpected charges in the invoice


    TDA .........................................: $ 595.00
    Gasoline ....................................: $ 14.24

    They are saying that they can do $200 over invoice. If I do not want to pay it, I can give up the car. I need the car. I have been waiting all these months. I know that the PiP is in high demand and they probably have several offers from those who did not pre-order.

    I was originally given a quote from my local dealer for $500 below MSRP. Since Hayward Toyota was offering $ 1000 below MSRP, I went with them even though it is 2+ hour drive from my place.

    I am okay with paying this money if this was really an unexpected thing for them - but I have a hard time beleiving that Toyota decided to stick an unexpected charge on the invoice. If this is really bait and switch, I should only be paying what is on my negotiated price.

    They say that they are only asking for $200 over invoice. To me, this is fair - but from what I know, dealers get other incentives to cover costs. What bothers me is that I feel they are doing a bait and switch and the fact that I have to drive 2+ hours to get the car when my local dealer had offered it for the same price they are now agreeing to sell the car.

    If you read this thread, I would really appreciate your thought on this. I would have ordered from you if I lived in So Cal. My experience with dealers has not been a good one and I understand that you are quite an exception. I really value your opinion here.

    What figure are they giving you as being $200 over invoice? Is it lower or higher than $1000 off MSRP?
    In any case, I think they are bound by the original agreement as agreed to on the Toyota ordering system.
    There is another thread on this forum regarding trouble getting the dealer to sell for the agreed price. I will try and find it and edit to include that thread.

    The buyer was able to get Erica with The Prius Team involved, and in her case, they arranged for a different car. Her dealer had added unordered things to the car and jacked up the price. All you need is for Toyota to step in and make the dealer comply with the original agreement.
    If you do wind up paying based on the invoice, you should demand a copy of the invoice and compare it to one for a duplicate car on Edmunds.com or Kelly Blue Book.com
    But the bottom line is they are not supposed to do this sort of thing.

    I know the fuel cost was on mine, but it was negligible. I worked out such a great price, like you, even with this cost the price was acceptable in the end. There is little margin on the Plug-ins for the dealerships.

    That being said, I also thought the price in the agreement was the price so maybe send a pm with a link to this thread to Prius Team on here, maybe Erica can answer some questions (or Dianne as well if she sees this).

    I say - they should have known what was going to be on the invoice before negotiating a price. They are the only dealership I've heard of that was offering $1000 off MSRP - sounds like this is why.

    Stick to your negotiated price.

    this is nonsense. "we've only been selling toyotas for XX years but we had no idea about this fee!" fat chance. contact the prius team and see what they can do.

    almost went with hayward toyota and now i'm glad we didn't, if this is true.

    oh by the way, doesn't the agreed upon purchase price and the process of picking a dealer and having the dealer submit the price to toyota's website constitute a contract? if so, does this make hayward toyota in breach of that contract?

    LIARS! and the advertising is for their regular sales, not for your pre ordered pip. there was no advertising for that.

    I am double checking with them - but I believe the figure is now $32,424.94 (invoice price - $30720+ $140 (mats) + 760 (destination) + 595(TDA) + 14.94 (gasoline) + 200 (markup))

    My original negotiated price was $31,906 (so this is $523.94 additional).
    In the phone conversation, he mentioned waiving the gasoline fee - but did mention that he needs $200 over invoice. This is why I am double checking.

    My biggest botheration with this is the fact that they advertise a cheap price to get business and then last minute haggle - they think they have upper hand because there is much demand for the vehicle. Plus the fact that I have to take one way rental car plus the inconvenience. I could have avoided all this if I just stuck to my local dealer.

    LOL! I AM impressed that you had negotiated to $1000 below MRSP. I didn't get any mercy.

    Well, it depends on how hard you want to push, but I don't think it's unreasonable to ask them for a pickup service, so you don't have to rent a car to go pick it up.

    I would REALLY hammer home that you specifically went with them due to their best and final price.

    contact the prius team and get their help. you are going to get this car for the pre-negotiated price. anything else is extortion and very likely breach of contract.

    I did not negotiate anything. This is what they were advertising around here. I called them when I got the quote from my local dealer and they said straight away that they would do $1000 below MSRP

    So did you actually pre-order through the Toyota site or did you just answer an ad in the paper or ???

    From what I am reading into this, it sounds like you ordered at another dealer, but then went with this place because they offered you $1000 less than MSRP. Did you cancel the first order?

    Is this a pre-order or something from a dealer's allocation?

    I pre-ordered through Hayward. I still have the price # 31906 in "my order" at the Toyota website.

    I had originally chosen my local dealer. I rejected the local dealer's offer and then made Hayward my preferred dealer. The price I got from Hayward is through the official channels and it reflects on the toyota website

    they don't care about this. my theory is this: green stickers are appearing on PIPs around the bay area and people who were clueless about the preorder are seeing these cars in the HOV land and subsequently going into their local dealers and asking for the car.

    hayward hopes to make you give up the car so they can turn around and sell it to someone else for 1000s over MSRP.

    don't give up the car. that's your car, and they are going to sell it to you for the agreed-upon price.

    The $760 destination fee is supposed to include a full tank of gas and specifically mentions it on the sticker price of the car. There is no reason that you should have to pay a fuel surcharge on the car. I have bought 4 Toyotas in the last 15 years and have never had to pay an advertising fee, separate fuel charge or any other sort of markup. The price that you agreed to when you ordered the car is the price that they are contractually obligated to give you the car for.

    So I just picked my car up yesterday from Berkeley Toyota.

    We used the agreed upon price (MSRP), there was no TDA or fuel charge.

    Have you gotten the email that says "this is our final communication", or that the car has left the port?

    If you go to the Toyota web site and select to print your order, you'll get a copy of your contract.

    The contract does say " This price also DOES NOT include taxes, vehicle registration and certain additional fees. Customer agrees to contact Dealer and Dealer agrees to provide details regarding these additional fees. Customer shall pay the agreed-upon price, together with taxes, registration and fees ..."

    I assume that means any license and registration fees. Do they still charge document prep fees? Edit: From the DMV web site: "Dealers may charge buyers a document preparation service fee not to exceed $55. This fee is not required or collected by the department."

    However, I seriously doubt that it includes TDA, and it certainly doesn't include markup.

    Tell the dealer you definitely want the car but you can't pick it up for a few days. Then PM Erica / Prius Team. This is dealer sleaze and you should not let them get away with it.

    Vine, your experience got me nervous, so I called Andrey at Putnam Toyota. They will charge the agreed-upon "your price" on my order, plus sales tax, California license fee, and the $55 documentation charge that the state allows. That's it.
