    What a bunch of crock! If he understands the law, he knows this lawsuit is frivolous. I live in Orange County, so does that make me accomplice to endangering its residents because I continue to drive my Prius daily...

    Orange County DA Threatens Suit against Toyota

    Tony Rackauckas, the local sabor rattling DA here in O.C. is still trying to make himself into a politician. He's going to 'save the county' it seems, by suing Toyota ... he'll make 'em stop manufacturing defective cars:

    Thanks for that Tony. Let's see ... O.C. economy in the crapper ... housing prices at an all time low (thus, WAY less property tax coming into the county to fund the basics) and MY favorite ... Mr Rackauckas fame for wasting taxpayer dollars:

    Seems he's branching out now ... hoping to shake down one of the county's successful businesses. Thank Gawd ... because if it wasn't for fine entities like him, Toyota couldn't get their issues taken care of. Only he can do it. Not the National Highway Fed rule enforcers, not the Federal legislators ... nope, it's got to by Mr. Grandstander.

    There goes any chance of him cleaning up the yearly 500 violent crimes per 100,000 population in the city of Santa Ana that he works out of. Decades ago I used to date one of the OC deputy DA's who got her undergraduate schollarship via fraud. Maybe Tony ought to clean up his own glass house before throwing stones.

    LA Times indicates that the City of LA has opened a criminal investigation:

    "Meanwhile, the Los Angeles city attorney has opened a criminal investigation, Isaacs said. The city has a fleet of about 750 Toyota vehicles, among the largest municipal fleets in the country, and broad jurisdiction to bring consumer protection suits, Isaacs said.

    "There appears to be a pattern of reckless disregard or evidence of concealment in the past," said Isaacs, a former federal prosecutor.

    Isaacs said the city would examine whether Toyota or its dealers provided false assurances to consumers about the safety of Toyota vehicles, which could be either a civil or a misdemeanor criminal violation."

    The potential for individual government agencies like City of LA to bring suit against Toyota is the real risk for them (Toyota). Do they want to be defending criminal actions in every state of the nation?

    Look out Danny - you might get hit with "willfully and neglegently allowing a forum safety defect to exist while not informing forum users that they were in danger of double posting!" I can see the City of Los Angeles jumping on this!

    Sounds like LA and Orange Country are spending too much on lawyers. The whole country knows how good LA is in pursuing criminal matters (do these gloves fit?)

    I doubt it will happen in some states, ie Kentucky, Texas, Illinois.

    I doubt there will be jury nullification in any criminal proceeding that may be filed in LA this time around. If anything, Toyota may be wanting to move the venue to somewhere else.

    Those states combined do not touch the Toyota sales volumes of California.

    They don't seem to care how wreckless they are when it comes to prosecuting the innocent. I guess it's ok to wrongfully ruin someone's life and you STILL get your license reinstated in 4 years. And you get to keep your license active while you appeal all the way to the supreme court. Guess that's one of the pearks of being one of the DA's favorite rising stars.

    I suppose Tony would have to find one person in O.C. that had unintended acceleration ... or even better ... one of the county cars. OC rapid transit (bus) has a fleet of about 50 Prius, so I suppose there are other Toyotas as well. If one of them had an issue? Maybe then? There's the nebulous "danger/threat" of potential harm he could always claim. You know the ol' saying. Anyone can sue. Most get tossed. And then again, he's just saber rattling right now ... threatening to file. We'll see if he follows through.
