Suing Toyota

    Yes, I have been sued by a scum lawyer after a four car accident.
    That sleazzy lawyer was the driver of the first car which just got tacked by the second car with only a scratch on the bumper.
    He filed suite two year later against the other drivers at the last day of the limit of statue limitation claiming his car is totaled and he is disable and unable to work after the accident.

    Yes, people in this country have the right to petition for redress. Yes, the defendant also has the right to use the courts. I would like to see these cases go to trial. No settling for a quick or not so quick buck. It took 20 years for the Exxon case to go through the system. I believe this is the root of the problem.

    As I originally said, yes our legal system is flawed. I'm really sorry to hear about your personal experience. But I would offer that while people such as yourself can become victims of unscrupulous lawyers that still doesn't mean the entire profession is flawed or that we should limit peoples ability to sue for damages. Even in your situation, the driver happened to be a lawyer but he could of just as easily been a donut maker.

    The freedom our legal system offers individual citizens can be abused. It does get abused. But even given it's flaws I'll take it. You may disagree but I'd rather have to deal with the waste of numerous unfounded lawsuits and preserve the right of people to sue for legitimate damage than surround corporations with an insulation of protective laws making them unassailable.

    You'll hear various stories from time to time about the spilled coffee and the multi-million dollar awards...but often many details are left out...the reality is corporations win much more than they lose.

    I am sorry to hear about your situation, but you were evidently dealing with a lousy person, and they would of been a lousy person whether they were a lawyer, doctor or indian chief. Again as I said, every case is unique and thus needs to be judged individually, that is why blanket ideas about lawyers in general, or the nobility of corporations and the "sleaziness" of those wishing to sue them need to be aproached very carefully.

    I'm curious, how did your case play out? It is a waste of time and money but often unfounded cases do end up being thrown out, or resulting in little reward for the unscrupulous. I know if you had that personal experience it might be difficult to believe but we pay a price that includes negativity for the freedom our legal system offers but the danger is to make it closed and automatic with no reproach for the average citizen and IMO that would be a much, much worse situation.
