Toyota Prius crash prompts emergency court filing

    Well, I was getting ready to say that she pulled a James Sikes, but it looks like a pedal misapplication moment. If highly trained pilots sometimes make mistakes "Pilot Error", drivers also do make mistakes resulting in accidents. It is a human thing, when something horrible happens, we defend ourselves and blame others.

    The headline is usually: Runaway Prius. For me, the word runaway is like a pet or a teenager who left home on their own, a car without a driver, but if the driver is sitting in the driver's seat with both legs and feet in the footwell of the vehicle, it is a tough sell.

    Ok on the GenIII you can't just press the power button you have to hold it in untill it shuts off, your saing your car you have to hold the power button if for over 1 second but less than two. if you just tap the gear selector to N in my car noting happens if you hold it there it will shift to N. Your car doesn't do this. I was just saying a press is alot less than a second.

    Can we agree on "you must press and hold the power button down untill the car shuts off" you can't just press it? And "You must press and hold the shifter in Neutral untill it shifts to neutral" That way we can cover all years of Prii?

    In the Genii the brakes will override the gas pedal. I've videotaped the process for youtube. If she decided not to use the brakes then she has no case.she is just stupid.

    as she admitted (see my quote in post #38) ... saying that she had both feet OFF of the pedals. So ... how DO you stop the car - with both feet off the pedals. :p When this gets tossed out for having no merit, I wonder how much she'll be paying Toyota when they (rightfully) sue her and her attorney for tortuous abuse of process.

    yes most of the time. But accidents can happen, i would be man enough to admit if i hit the wrong pedal. Most people are cowards and always blame everything on others.

    And again I agree I would do the same but obviously in this case the woman stated she took both feet of pedals Wth how would that stop a speeding car???????????????????????????? Again some people are idiots!:der:

    No car or truck stops when you remove the key. The gasoline is cut to the engine, but that is all that happens. If the lady is going 15mph through a shopping mall, no vehicle is going to immediately screech to a halt just because the key is removed. If this attorney is basing his case on this statement, then he might as well withdraw before the media plasters his name everywhere.

    This occurred on a weekday at a shopping mall ? :rolleyes:

    I agree, I think her Attorney is going to tell her soon that there is no case because of this statement. she is going to be sued for damages of the store, elevator, etc..., and Toyota will probably start suing back to stop this behavior.

    how can toyota stand by and not do anything about these false accusations? as a manufacturer, i can't see why they don't counter-
    sue these idiots.

    by any chance, sikes was behind in his car payments right? how about
    this one? is she behind in her finances, looking for a quick way out?

    What if you have just come to realize that the harder you press the brake pedal the harder the car accelerates??

    Not saying that's what happened but with almost total control of the system via single-threaded software programming anything is possible.

    Likewise pressing the wrong pedal will produce the same effect. Which do we think is more likely: a total failure in a heavily tested and redundant control system, or operator error from an amateur driver? Hmmm, let me think about it for a bit.

    I've done this myself, several times. I'd guess that most of us have.

    Pull into a parking area and open the door to get out, but don't press the P button, the car will take off on its own as soon as you take your foot off the brake.


    The public til now has been trained to shift a lever up into Park, take the key out of the ignition then get out.

    Now with the Prius the key fob is in a purse or pocket and there's no lever to shift. It's entirely new. Getting out of the vehicle without putting it into PARK is easy to do when distracted.

    Not to worry as soon as the data is in from the computer it will show that she pressed the throttle and not the brakes. The lawyers will crayfish into the night.

    After watching the video, I call BS. The lady is twitchy like a kid who got caught with his hand in the cookie jar. But I'll send the link to the video to a friend of mine who's a deception expert and see what she has to say about it. My guess is she'll agree.

    you are not going to go through half of shopping mall at 5mph.

    she had to press it deep down for it to go through structure like that. It is not an tank.

    I think a Prius drove by causing the "unintended acceleration"
