My horrible Prius experience thus far! Can I claim Lemon now??

    I bought a Prius 1.5 month ago. I have taken it in 3 times so far for the same issue. Each time waiting in the reception area for about 3-4 hours. Today will be my fourth time (and if they don't fix it) it will be a Lemon Case. Period. However, yesterday I drove my Prius home, everything seemed fine, and then today I went out to my car to see that the back had been dinged up by some scratches. Looks like someone hit or swiped my car, and so there are now some scratches on the back. Can you claim a Lemon if you have scratches on the back of the car??? Am I screwed? I'm freaking out. :(

    Depends on what you mean by 'skrood.'

    First of all....even in the (finger quotes) Empire State, four visits to a dealer does not a lemon make. It probably just opens a case. You still may have a loooooooooooong tough slog before the change owner light comes on.

    OK.
    So....
    You have a dinged car, and you need to get if fixed. (Or...not.) You need to look at your insurance policy and determine what your deductible is for your comprehensive coverage. I always advise people to get as high a deductible as they can afford since this will not only lower your insurance rates (even in New YOWK!) but you really do not want to start whamming your insurance company with claims every time you get a door ding, otherwise two things are going to happen:
    1. You're going to be a harder to insure at a reasonable rate.
    2. Insurance Claim = accident/incident. NOBODY wants to buy a wrecked car.

    If your Comp deductible is $250....$500...$1,000 that obviously means that you have to fork over that much before the dings get fixed.
    The next thing you need to do is find out how much a competent body shop wants to fix it. GET MULTIPLE ESTIMATES. Tell the body shop guy or gal that you're fixing this problem on your nickle. Sometimes they will write the estimate with a skinnier pencil if they know that an insurance company is not footing the bill.
    OK...so now you know how much your coverage is, and how much the damage is.
    Now you can guestimate other factors such as whether your insurance rates will rise (or not fall) in the year or two if you file a claim. Most insurance companies go back five years for accident history as far as claims are concerned (sometimes only 3 years for moving violations) so think about this if you're a frequent rate shopper.
    Now...you need to think about dating or marriage.
    If you're a girl and a really cute guy comes along and says "Hey...I'm really clean but I did have this really minor STD a few years ago....."
    Guess what?
    Try selling a car with a "really minor" body repair. :eek:
    Same thing.
    Think about this before you attach your car's VIN to an insurance claim. Paper can last a long.....long....long....LONG time!! :(
    If it were me....I'd leave the Lemon Law out of the equation. If you do get a settlement you need to start buying lottery tickets, cause you're going to be one of those one in ten million kinda people. You're also probably going to get a settlement...not a new car for old car dead even swap. They'll factor the damage you did to your car when they tabulate the settlement.

    Don't freak out about the damage. Life is waaaaaay to short to sweat stuff like that. :)

    Youll have a hard time proving the damage was done at the dealer if you drove it off the lot and found the damage at a later time.

    Scratches are $500 tops to have the bumper repainted.

    If the dealer is reputable, you may get them to fix it.

    Both of the above methods will keep da,age off carfax keeping the vehicles value in tact.


    Nothing there has anything to do with a lemon law.





    What is the real problem with the car?

    The problem may be in getting the dealership to acknowledge and document the problem has been presented four times without resolution. If you bring the car in for service- they road test it and simply write "cannot verify complaint" or "unable to duplicate problem" or something like that- that won't help your case- especially if you start mentioning your intent to use The Lemon Law against them.

    As of now they took in my Prius, gave me a different one to temporarily use and they are going to have a "Toyota Specialist" diagnose it. Hopefully this will resolve the issue! I'm just very fed up with this because I drove the Prius they lent me for now and it is SMOOTH over 60mph! Just as it should be! Ugh! :(

    I am still more confused. You would be happier if every Prius had the flaw yours has? Why is it not good news that other Prius do not have this flaw? (How could they repair it if they ALL had that flaw?)

    Your not going to get a lemon passed by your complaints so calm down. Your making more out of it then its there.

    I know its frustrating and id be ticked off too for the time lost, but they will get it fixed for you.

    Slightly out of round tires do pop up now and then and you may have a front one that is bad.

    The road force balancer shold have caught it, but they only spin it up so fast and they dont spin it up as fast as where your seeing the problem.

    Id have them swap out another set of front rims and tires, but thats a tech issue. Sounds like this shold be the last visit and their on the right trail now.




    I had a toyota truck that had these issues due to Souzas tires in Aurburn Ca, his stoner workers pinched my rims taking off my old tires. Took 3 visits to figure out what it was. Took the rig to Less schwab and bought new rims and she went down the road straight again. never got that crook to make it right.

    They already replaced the front 2 tires and it made little difference. I am not an expert on tires and such, but I am extremely frustrated. It was very nice of them to lend me a temporary Prius however, so that has calmed me down a lot.

    could you PLEASE state what the problem you think the car has ??? otherwise you are wasting your and our time ...

    For WHAT issue did you take your car 4 times to the dealer shi;p ??? (did I miss it ???)

    This might just might allow someone give you an intelligent advise ...

    OK read that post (the linked one) ... HE clearly says at the same speed some road are smooth but the one he drove was not ...

    That to me just proved this is not the car ... :) Man I hate that the car bouncing up and down the the Kotch bridge when I stopped ... so this must be a lemon ??? I go the car Nov 16 2012 so mine is brand new too... (third prius though)

    NO WAY this will make the lemon state
