My 2011 prius tboned Friday...now what

    Yes, the insurance agent initially stated no way will I be entitled to it, it isn't relevant with door damage. She is so incorrect now that the estimates are so high, we are entitled in Florida, but will they offer it? I have gap, and a loan, was not upside down on the car , and it was pristine under 35,000 miles. We just wait.
    I asked a Toyota salesperson to value my car for a trade in towards a new Prius, or replacement. Its a start anyways. Thankyou for letting me vent.
    Diminish value, sales tax, dealer fees ,closing costs add up. No matter what, it seems like we lose .

    How were you after this accident? This is my biggest fear, especially in the backseat with my two little kids. One is six and the other is two. My most precious possessions.

    If we were in my Aveo, we would be in the hospital I am sure. The Prius is still our first choice for safety and reliability.
    Keep the kids buckled at all times......

    As of today, they will fax another work order to total just under $12,000 worth of repairs to date (initially last week it was $12,400 ) . Of course, if they find more issues, they will call for the adjuster to inspect once again. Once repaired, Toyota will run diagnostics to make sure all is ok ........their salesman has valued my"trade" in around $9k to $10k towards a purchase if I chose to trade in after repaired. I owe $16k.
    S0, it was valued at $19,900 retail four months ago when we bought it.
    Yes, we will claim DV, sales tax and title replacement costs......and see where it takes us. Hopefully, after repairs, it won't rattle and make strange noises from repairs....and being hit so hard from the side, they assure me Prius was made for such structural hits, they doubt they will find more repairs once they commence the job.
    The insurance company does not want to total the car so far it seems as their ratio hasn't been met according to my insurance company..........
    So we wait another week. I am enjoying PriusChat as I wait this out, at least I am learning about the car I really miss driving! Thankyou.
    ps My rental is a Mazda 3, which was a purchase consideration to the Prius...glad I didn't buy one....not as comfortable as my Prius... it is a "Zoom Zoom", but I have had to buy gas twice already this week! I want my Prius please.

    Hmmm
    If it was mine I would be tempted to stop the repairs, collect the $$ and keep the car. Sell the car as a "fixer with a clear title". It should bring 4-6 thousand to a bodyman wanting a little side job. You should be able to come out quite close to "whole".
    Just a thought.

    It would be complicated for us to do so. We owe money on the car, parts have been ordered, and the Toyota Collision Shop has been authorized to complete the work. If diagnostics prove the car 100% repaired to original specs, we have our car back. Your thoughts are worth consideration , though. And we will claim diminish value .

    I like the 'out of the box' thinking!
    But as the OP has already pointed out, it's not really their car as long as the bank has the title.
    Besides that, the title isn't ever going to be 'clean' again.
    Not ever.
    Once your VIN goes onto an accident report, your car will always and forever be "wrecked."
    It's like getting an STD.
    Yeah.
    Sure.
    It was really, really minor....and they cured the patient one-hundred percent!!!
    Good as new!!!! :)

    That's where diminished value comes into play.
    The insurance company has a fiduciary responsibility to their 'real' customers (a.k.a. stock holders) to fight you on DV, which is why they tried to tell you that you're not entitled. In a just world.....the government would set up a formula to compensate you for DV however (comma!) it's not, and they don't.

    So......like I said before.
    Negotiate, or litigate.
    OK.
    So.....that's the bad news.
    The good news is that now the OP has one helluvan incentive to put another 200,000 miles on the Prius.
    That's when they really start to pay you back, and there's every chance to believe that once properly repaired that this car will last you for another 10-15 years.
    If you get DV, then plow that right into paying the car OFF, and then just keep it.

    Diminished value is like a stock quote.
    It's only relevant if you're buying or selling. ;)

    My Bimmer was rear ended, 8K in damages, dealer BS repaired it and drove it another 3 years and made 16K when I sold it.

    Our only choice is to sit, wait .....until the next phone call something else is wrong.....or come get it.
    "I just want my Prius please", maybe I should coin the phrase !

    Still waiting, car should be ready early next week, in the paint shop . The Collission department has been very good with updates stating it would need another $7k before thh insurance company would consider it a loss.
    Then the test drive:) and hopefully home.

    Update to the update.....parts(doors etc) being painted, car should be pieced together by tomorrow, collision shop will test drive to make sure no "wind noices" or rattles are evident and will call me to pick up possibly by Friday or Monday.....

    Run the hose with water over the doors and windows and hatch and make sure the compartment is sealed when you get home.

    Yes, that is one issue I am fearful of....water intrusion.....the collision shop manager has driven the car next door to Toyota service so I can have my 36k mile maintenance and oil service(tires rotated , too)....before warrantee runs out. What ever collision repairs have been done are 100% gauranteed as long as I own the car.
    The car was absolutely flawless when we bought it....
    Possibly Monday the car will be released back to us after the adjuster signs off....We will take it onto the highway, run her home and hope for tropical rains...or I will pull out the hose for a true test.

    I will post an update after delivery , and work on DV next as my trade in value is now only $10,000.....at the dealer .

    It's Tuesday.....Still waiting for the insurance company to pay & sign off....the car is waiting to come home......my rental needs to be returned tomorrow.......
