In Oregon? I think attendant topping off of the tank is so common, nobody does anything about it. And while it is legally banned, the ban is promoted primarily as an environmental protection issue. That is any violation is handled with warning, only possibly elevating to very modest fines.
I've actually never heard of any station or attendant getting into any trouble for topping off the tank.
As much as I really do not want them to top off my tank and would rather they do not, I simultaneously feel these people have a harsh job that really offers meager pay.
I'm not going to press the issue to any legal complaint. I've just come to the conclusion that I have to take the responsibility of making sure I communicate that I don't want the tank topped off.
I can't trust that I can go inside to pay, and that the attendant will follow Oregon law, and actually NOT top off the tank. Regrettable, but not something I feel like I want to go to the extreme of video taping and filing complaints. It's so common if I started doing that, I'd be filing complaints at the majority of stations I go to.

I kind of blame "Oregon" for being only 1 of 2 states that still doesn't allow for Self Serve.

So you pretty much have to supervise the guy. Something wrong with this picture.

Chevron made some noise about allowing self-serve in Coquitlam, about a year back, never heard since.

If no one speaks up, then it won't ever get enforced.

While I won't complain about 0.1 gallon over, as that is similar to the normal cutoff variation, I would make a scene about an un-permissioned 0.5 gallon over.

I was happy to do my own legal self-service earlier this year in Oregon. Hood River? It was somewhere along the Columbia River in a county small enough to be legal under the new law. A sandwich board out front noted that it was now legal, but attendant service was still available by asking. They even asked unprompted, but I waved them off.

    Interesting...
I live in Oregon and actually hadn't heard about this change. BUT...
Reading the article it seems very limited to only small population, rural counties. Overall? Oregon is STILL a no self serve state.

Interesting article however that it appears Oregonians as a whole are still not happy about the "Self Serve" option. I guess I'm not in sync with the majority of fellow Oregonians, as I would rather we simply allow self serve everywhere.

Since 48 other states, seem to be fine with allowing their populace to pump their own gasoline, I don't know why so many Oregonians seem to think it would be advancing the end of days, if Oregon joins the majority here.
Kind of disappointed to hear the rural area law change was met with continued resistance. I'm ready for a state wide change.

    LOL!
    I don't know...I take it seriously...I don't take it seriously.....
The funniest or most frustrating thing is that I have found that if I pull up and politely ask or say..."Do Not Top Off The Tank". I will inevitably get a dirty look, like I just asked the guy or gal to NOT pick their nose, and I get the incredulous exclamation that they NEVER top off the tank.
BUT...almost guaranteed that if I don't say anything, and don't supervise? It is pretty likely they will top off the tank. Not every time, but a great majority of the time.

My suggestion would be this, since the dealership is doing almost nothing to help solve your problem:

After this tank is empty and you refuel, disconnect the battery for about a minute. This will reset the ECU and clear all memory. All modern cars "learn" the driving behavior of the driver and adjust the parameters of the car on the fly. Resetting the ECU forces the car to relearn. Then drive like you would normally, but keep your receipts. May take two or three tanks to see if this will help or not.

BTW, when you disconnect the battery, some minor things will happen. If they do, don't panic.

You are right. Every time I need to fill it up myself, I feel like an idiot because I keep forgetting how to do it. When I explain people I am from Jersey they all become understanding :)
