Rear ended think it's fixable?

Im on comp number 10 out of 12. The best comparable car they have which is 2008 with 79k on the clock for 11,999 which they know down to $11,311 after "adjusting" the price has 3 accidents on it, was a movement fleet vehicle with no maintenance history to show. Also has a tow for mechanical breakdown and a filed emissions inspection awhile after. Then shortly after that it only was driven 1,800 miles in 2.5 years and sold. So it went from being driven around 7,000 miles a year to less than 720 average for the last 2 and half years of its life? sounds to me like it may have some issues with it given the history. Who knows. But still more miles then what the NYS code says to use and when compared to mine has a rougher history. More miles and for sale for 12k with a multiple accident history!

2 pages in so far of shooting down their "comparables" once I'm done ill add in my comparables and I'll make sure they are actually available and provide links to be helpful!

 

Almost as bad as someone making comments when it's obvious they didn't read any of the post. At no point did I ask anyone for legal advice, since when would asking someone's opinion on of they think a car is fixable or not legal advice? Finding a lawyer was mentioned from people who are trying to be helpful. Mind your business and move on

That sucks! I'm gonna hold onto this prius as know the history and know it was taken care of overall. If it was an accident I caused I would have just had it fixed without going through insurance most llikely.

Im very hopeful that these symptoms go away in a few weeks maybe the PT will help. After being out of work for nearly 8 years due to my first injury, Then covid and the need to be home for my kids i was eager to get back to work so keeping my hopes up this doesn't last!
The urgent care dr didn't offer anything besides telling me to take Tylenol and ibuprofen. Maybe the spine dr I will see next week will send me to pain management who could have some other advice.

 

I'm gonna push as hard as I can since it doesn't cost me anything but my time really! Ive researched every car they used a a comp and sharing why I don't feel they are good comparables. Mostly because of mileage. I'm trying to stick to the points about mileage and for the government fleet vehicle making a point about thats it was in a fleet and had 3 accidents. I am pointing out that the distances they put for where the dealerships are located from my zip code are inaccurate but I'm gonna clarify towards the end that I only did that to point out the inconsistencies/ errors in the report. Few other small things like saying my car dent have package #2 the it does, it says I dont have remote starter when I do.. and for some reason it says I have disc brakes all around when its very obvious I dont. This was all done by the adjuster at the bodyshop so she had the car in front of her not sure how these errors could have been made.

 

Nationwide I can only find 6 comparable models within 2008, mileages ranging from 56k to 83k. Going to 2007 or 2009 yields more results but not many. After adding up and getting the average price it comes out to $13,074.83 plus local tax, tag, document fees and waste tire fee the total is... $14,282.16. I look forward to seeing how close I can get to that number.

I found 3 trunk lids my color in my area which i did not expect. Both arnt in the shape i would hope but not bad. 1 bumper but its been spray painted a bit also. I found 2 perfect examples but 2 and half hours away, I would need to fix the brakes on my 4runner first and that would be a low prices given my back pain. Trying to decide what to do take the less than prefect example or push through and get the better ones farther away. Oddly enough the better examples are cheaper too!

 

I found one more that sold sometime in the last 7 days. Was first for sale on 06/10/22 for 13,995. made sure to send another email to USAA and CCC about it just to add it in. My guess is they will say that mine are farther away then theirs.. ya know the ones that don't exist anymore with no proof of when they sold or actually existed. Easy to make up details when can't find any information on them. There is VINs on each car when they push back ill ask for detailed sale records or carfaxes showing new title dates.

I have pointed out to them that comparing cars from over a month ago may not accurately reflect todays market values given the current state of the market. They will not like me.

I'm also working on my homeowners claim from april. Filed my appeal and got a call from the adjuster supervisor today. She was not as cheery as she was last time we spoke, I wonder if that has something to do with my appeal and the fact I emailed it to the CEO of State Farm also! I told her call next week Im in pain!

What were the details of your car if you care to share. Maybe ill take a look just to see what I find!

 

Ill take a look at what I find. If you don't mind share a zip or I see Colorado I can just see that. Sounds nice! Thats something I was thinking of doing was sound deadening as they are loud! hmm another option would be to try find a white hood from eBay or car-part.com from local junk yards. I may be traveling about an hour and half for the perfect parts for mine! Could try a local body shop or see if you have a local dent wizard and see what they can do and how much before calling insurance. I will try take a look later today and see what I find. My guess is with that mileage it would be around 8k to 10k plus tax tag etc. Can always strip what you wanna keep from it or f you have the originals put them back in of you went that route.

 

First search within 100 miles finds 3 2 listed as touring and one that has fogs but doesn't say touring. all over 6k cheapest one has 214k second 198k and 3rd 100k for 11,999. Could do ok price wise with some fight I'm sure. If it were me id get some quotes to fix it, if you wanna go through insurance you may be able to get 8 to 10 out of them fix it and throw something in your savings account. Thats my plan anyways. I have a set of touring wheels im gonna repaint and get some new tires for also.

Unfortunately its happening everywhere! I have 3 kids and often wonder what they will grow up seeing.

I sent in my 3 pages and an extra comp after to USAA and CCC. CCC emailed back and said they will not do anything with it until USAA sends it in. Funny how the adjuster at USAA told me to send it to them but they refuse to accept it smh

 

np. Keep in mind they will try offer you probably 5 to 6 given that they told me mine is valued at $8500! gonna take some leg work and fight to get anymore from them. I'm waiting to hear back now myself.

 

I finally got a response from USAA! Ignored what I wrote and comps I sent of course. I emailed him back something curious how he will respond. This is what they sent. If anyone wants to see my email to them let me know I can load it on here! One thing I did point out was this
I see many issues with the "comparables" that I was provided. Quick example
Example Comp #8 has 143,261 and is currently for sale for $8,495. Has noticeable dent on right fender, missing trim ring and center cap on right wheel. No other pictures available. The price then was adjusted to $9,551. Can you please explain that adjustment and how it was determined?
On the other hand below it is Comp #9 with 58,075 miles for sale for $10,000 ( which I could not find for sale on their website or Autotrader from where I was told it was sourced) and then it is adjusted down to $8,079 which is $1,472 LESS than a car with 84,186 miles MORE than it has. Please explain how the valuation was determined on this car and how it would have a value of less than a car with almost 3 times the mileage.
It has the appearance the report was made with adjustments to fit the price that wants to be paid for my car. My car has 66,105 and was valued at $8,449. How can my car which has LESS miles than comp #8 by 77,156 miles be worth $1,102 LESS than the comp #8?
I have a feeling he won't like me lol
