May my Prius RIP

    I was in a head on collision on December 23rd in my 2005 Prius with a Jeep Wrangler. I broke my collar bone but am otherwise fine. My injury was the result of my seatbelt - the other car pulled into my lane, so we were both moving at about 25-30mph so the impact was substantial.

    Amazingly enough, my Prius from the windshield and dash back is perfect. But the front end is so badly damaged it was totalled.

    Now I'm just trying to figure out what to replace it with. I'm definetely getting another Prius, but am not sure if I'll go new again or go used. I'm leaning more towards used since we just payed mine off and I'd rather not go with a loan again.

    It sucks though - she was a great car :(

    Any recommendations? I know I want the same features I had (leather and NAV) and will certainly enjoy any new features that go with it. I love the 2010 and the fact you can get a sunroof, but having just paid this one off, I'm not so interested in taking out a loan again.

    I'm glad to hear you're reasonably OK...and sorry about your baby. A 2010 with leather and nav will cost a lot more than your insurance $ but finding your specified replacement will be difficult. No really good advice but a lot of sympathy. :(

    I wished I had a salvaged car when I rebuilt My 2005 Try o get yours cheap from Ins. co and find one with rear end damage . You could have a really good rebuild with a little work for less than half price. zI had fun and learned a lot.

    First, glad you are somewhat OK, it could have been worse!
    Second, Talk to a Accident Attorney, it really is in you best interest.
    The insurance company will try to low ball you every step of the way.
    Third, if it were me I would find a nice 2009 and enjoy it!

    But no matter what, TALK TO A Accident Attorney, the first call is free!
    You did not ask for someone to drive headon into you for Christmas!!

    So sorry to hear about your accident. I'm glad to hear that you weren't seriously hurt.
    It does suck though. The entire process is such a hassle.
    I would like to put my .02 cents in. As a 2010 Prius owner, I say go for it!!! If you can, get a 2010 Prius. You will love it.

    btw, any pics of the deceased Prius? (Or is that too disturbing?)

    Thanks for the replies. My wife and I have talked about whether or not it makes sense to pursue any kind of legal action and we both feel it just doesn't. This was an accident and while it sucks at every angle its looked at, it was still an accident and I don't need to benefit from it.

    The amount the insurance company is giving me is reasonable and would allow me to replace it with a 2005 with similiar (or even lower mileage). They are also compensating my time while out of work and other expenses I'll have to incur for things I now can't do myself and need to pay someone to do.

    Overall considering the situation, I've felt its been handled reasonably well.

    What I think I'm going to get is a 2008 with 20k miles. Its package #6 and the dealer is asking $19,324. I'm going to see if I can negotiate that down, but it seems pretty reasonable to me.

    The worst part to the process is that rather then rent a car, I'm driving my Yukon. Boy my gas bill is going to be much higher this week LOL

    Well as everyone always say's in situations like these, it sounds like you're going to be okay and that's the important thing. Even though collar bone breaks are not fun. If I remember right, the cast/brace can be miserable. Do you have time? Because towards that end, if your collar bone is still on the mend, this might not be the best time to "test" a new automobile as far as seat comfort, ergonomics.

    In your OP you mention twice in about 3 paragraphs that you aren't thrilled with the idea of getting tied down to another loan. So I have to assume that's very important to you. But conversely, you are asking...which makes me think that maybe even subconciously you want some "permission" to think about a new Prius.

    I can't tell you what to do, is the easy cop out.

    I can only tell you what I think I'd do. I think I'd take the opportunity to go look at Generation 3 Prius. Get an idea how much more you like it or not. Also probably get an idea of how much of a loan it would take for this upgrade. You might find any combination of truths emerge. You might find you absolutely like the Generation 2 better, inwhich case there's your answer, you might find the 2010 so much better that agreeing to the loan becomes that much less painless. You might go to look at the 2010's and find the perfect used one sitting nearby. In anycase good luck, you're at least starting from a pretty defined starting point...you know you want a Prius....

    If the other party was at fault, HIS/HER insurance should be paying for your rental car. You are throwing your money away...

    This is EXACTLY why you NEED to consult an attorney....

    I just bought a 2010 and love it!!! Ina way I wish that I could've bought the Prius with the sunroof, solar panel and the rest of the things that can come with it but I am very pleased with mine. I have the NAV only. I have been wanting one since they first came out but somehow just never got around to it. Now I wish that I would've bought one when they first came out.
    Now for your predicament. You should at least be getting something out of your car so why don't you take that and use it as a down payment and then you can finance the rest and would probably come out of it with a fully loaded system!!!
    That's what I would do. My 2 cents worth.
    Good luck though and I'm glad you weren't hurt that bad.

    I know I could have a rental car paid for. I just don't really want to bother with a rental car. I simply prefer driving my own car even if it is a gas guzzler LOL

    I am having my Dad talk to a friend though just to see what would be involved in any kind a lawsuit. I'm not a fan of suing just because you can and if I end up healing 100% that's all I want, but this whole process is still costing me money that insurance is not covering.

    The worst part for me though is the loss of my favorite season (or most of it). I snowmobile all winter and at best might be able to in March.

    And that's why I'm probably going to get this used one if its in good shape. A 2008 Package 6 for $18k (if they take my offer) with 20k miles on it is a damn good deal IMO.

    If I bought new, I'd want all the features including the sunroof. That would be around $30k or slightly more. While I could afford to take out a loan and get it, I just can't see the benefit in doing that.

    I think I was just looking for reasons why a 2010 might be much better then a 2008. Or at least why its worth an extra $10k :)

    This is where the Attorneys work out what is FAIR for you and your wife, yes she also has a vested interest. Your TIME and EXPENSES need to be reimbursed.

    I painfully found this out many years ago, when I had my first accident here in Los Angees. Knucklehead turned left in front of me, TOTALLY his fault, and the first response fro the insurance company was "Let us help you, and promptly tried to LOWBALL me.
    Lucky I had a good friend who HAMMERED the Attorney thing at me, as I am doing, I made the call. VERY SMART MOVE on my part. Once the insurance company was contacted by the Attorney, the attitudes quickly changed. I got a NEW car, mine was totaled, I was out of work for some time, I was fully compensated, my medical was 100% covered. Lastly for putting up with all the CRAP the accident threw at me, they paid that off as well
    I did not "Get Rich", but I was pleased with the result. It was a far more fair settlement than the insurance company frist tried to fast trak me with!!!

    I truly wish you luck, you deserve a break, peace of mind, and a NEW car!

    You do make some great points.

    As I said, I've asked my Dad to talk to a friend of his that's an attorney. I guess we'll see where it goes.
