In NYS, uninsured motorist is for bodily injury only and not for property damage.

12 things your auto insurer won't tell you

Diminished value is based on the idea that any car that has been in an accident, regardless of how well the repairs are done, is worth less than the exact same car that hasn't been in an accident.

What you can do: In 14 states, it's allowable for you to file a claim for that lost value. See Diminished value payments when your car has been in a wreck. Thirty-six states and Washington, D.C., do allow insurance companies to exclude payments for diminished value, so if you live in one of those states, you won't get to claim the loss. But in Florida, Georgia, Hawaii, KANSAS, Louisiana, Maine, Maryland, Massachusetts, North Carolina, South Dakota, Texas, Virginia, Washington, and West Virginia, you have a chance of getting a diminished value payment.

The retail price quoted by the insurance company is high for my area but midwest prices are higher for the 2010 and probably are for used ones as well. What prices did you find when searching for 2005's with your option package and approximate mileage?

If there isn't any hybrid damage any good body shop should be considered. Since a Toyota dealer will have to do the alignment as the scantool is used to set the computer I vote for the Toyota shop as long as you are satisfied by what you see on your inspection and by their referrals.

Can't you file a suit against the other driver for whatever your insurance isn't covering (including consequential damages)? Collecting is another story.

    I'd talk to a lawyer.

    Good luck.

I agree with everyone here. Get a lawyer.

Is it legal not to have insurance in your state? What the heck.

    finilly have time to update.
Car was fix, Body shop didnt look past the damage (body shop is/was a Toyota cirtified shop)
Btw total cost to date $10200 in repairs

    Whats left to fix(What a #$$# nightmare)
Driver fender isnt way out of alignment
Driver window piller is 1/8 higher then passagerside
Rear roof leek (under drip rail) bodyshop fixed it with silicone:eek:
Rear driverside door at upper back corner is at .020 gap with roof rail (passager side almost 1/4" all the way)

Took the car to 18 bodyshops and 5 Toyota shops. None are willing to fix the car. reasons they gave me
"Repairs wont exhibit the same safety protection they were intended by the designe of the cars safety system"

Insurance adjuster, Toyota rep for body shops and i met in 2 wks

    Ill keep you posted

    Almost forgot to mention
mpg before 46, now i cant even get 36
