Just put my Prius in the AutoTrader

    Yes of course any terms can be negotiated, and the seller considers the commission in the price. But the seller pays the commission, it is their property. You can't pay a fee and sign a listing agreement to sell a house that isn't yours to sell yet. I would run away fast if any agent tried to pull that on me. To pay commission is just another, I think underhanded too, way to say pay more please. Doesn't fly in my neighborhood, keep your house is what I would say. Rarely would a buyer sign an agreement with their broker saying they pay part or all of the commission. If they did, in this market where there seems to be more agents than people, they are really really naive. I have never heard of such a thing.

    So what car would one replace their sold Prius with, that is better for the money? I can't think of anything except maybe a good old car for cheap, or a classic car that is under priced.

    Mr Vandenburg I am a Real Estate broker and I am *telling* you what the buyer broker agreement says in my marketplace. It isn't open to interpretation or argument, this is what the agreement says...it is a fact. The agreement as written from the local board of realtors states that it is the buyers responsibility to pay the agent, but there may be a fee that is offered to the agent by a listing broker and that fee shall be applied towards whatever the broker and buyer have agreed upon in the contract. However, if the fee offered is less than the agreement between the buyer and their broker, the buyer owes the difference at settlement. So...according to the contract the buyer may have to pay some, or all of his agent's commission depending on the situation with whatever home they choose.

    If you want me to email you the form...let me know and I will. Thats what it says though, just in a long page of lawyer-ese.

    Like I said, most agents don't enforce it, and some, including myself, add into the agreement that in the event that what is offered in the MLS is less than what is agreed upon in the agreement, whatever is offered in the MLS is accepted as fulfillment of the buyer's responsibilities to pay the broker. Most don't do that though, even when they never intend to enforce the agreement.

    Have you ever read your local buyer broker agreement? I bet it says the same thing. Almost every agreement I've ever seen from another jurisdiction does, GCAAR's agreement does (Maryland & Washington, DC), Northern Virginia does, Pennsylvania's does, Delaware's does, New Jersey's does, West Virginia's does...I found one agreement from the Sussex County, DE association of Realtors that does not. Thats the end of the forms I have access to online, so beyond that I couldn't tell you. People sign it all the time. Its the buyer that is hiring the buyer's broker and the buyer's broker is legally representing them as their agent, which is why the responsibility to pay them is on the buyer...whether in reality the buyer pays or not. If the agreement says that the seller pays and the buyer does not, there's an implication that the buyer's broker really represents the seller. Ultimately the seller covers the buyer's obligation for them...but its always the BUYER'S obligation.

    I just paid $14000 for a 2005, nicely loaded, with 19k miles. Yet cant seem to get $9800 for my 2005 w/123k miles.

    i think prices are rising tho, hang in there, don't give it away! i would rather be a seller than a buyer right now.
