Sounds like the shop found out it was a Hot car, while in repair shop.
That is the car she did have.?????? Just guessing...

I called the private dealership i bought the car from and had them pick up the car to take in to have repaired and a week went by and no one updated me on the status of repair. I finally got a hold of them when the owner states "I thought you turned the car back in" I told him he was losing it because i never signed anything stating and I am still under contract and he was only sopposed to repair it. He says oh yeah I did say that and stated the new buyer had brought it to dealer that said nothing was wrong with it. I know it is illigal to sell a car to someone without first informing the person under contract and especially if I did not sign anything to terminate my contract. This happened a few hours ago so tomorrow will be fun (for me)

Ok, so this dealer sold your car to someone else when you took it back to him to be repaired. Wow, that's pretty bad.:(

Anyway, where exactly is the car now?

I drove by the dealership this afternoon and thought the sold sign on it was because they wanted to make sure no one bought it since it was only suppossed to be there for repairs. Just checked toyota sight and it does state it was taken there and all things were looked into last week

I am bringing criminal charges up on them in the morning and getting my money back for it since I most likely cannot get the car back

If you can get your money back including the money you spent on the 12V battery and the traction battery, I think that would be the best outcome for you. Frankly, the car did not appear to be a very good choice for you, given the 172K miles logged on the odometer and the large number of issues that you had reported earlier in this thread.

I really do not want the stress of the vehicle. So I am just going to be taking them to get the $4,000 spent on the car during the 22 days I had it for.

If I'm not mistaken, they are holding the title to the car and you brought it back and handed them the keys. Is the car registered to you? Sounds like they know what they're doing.

If you spent $4000 in repairs, you most likely will not get that back

    SM-N900P ?

The worst part is you are right..they do have the title and we had not even received the tags or anything for it yet since it was less than 30 days before it was brought in

The dead giveaway to your problems is the dealer saying "I thought you turned it in". That is the sure sign that you are in a bad position.

Best case scenario, they refund your initial deposit (if you left them one). Unless you can prove you brought it in for repairs only (like a receipt stating so, but you called them to have it picked up:( ), they would just say you turned in the car and cancelled your contract. If the car is not registered in your name and you don't have the title, I'm not sure what you can do.

Yeah but there no paperwork done to terminate the contract and no late payment

They don't need one. They have the title, it's not registered in your name, they have the car and keys.

You definitely will need a lawyer to proceed but I'm certain this dealer has done this before and they know the process. It'll be an expensive lesson.

This whole scenario smelled funny from the get go, but if you're lucky you you used a check to pay for the car which you can use in court (you can get a copy of the cancelled check from your bank first.........then you'll need a lawyer to proceed any further with this case because the dealer sounds like they have made a business of doing this to people repetitively). If you used cash well then you are likely SOL on this one since you have no other leverage to speak of at this point unless you have some other proof of payment to them.

This is certainly a weird case. Shouldn't the OP have at least had a receipt or bill of sale of something even if she paid cash. Gotta agree though about the whole scenario sounding fishy from the beginning.

Hopefully she will come back and update us on this bizarre case.
When I bought my car recently, I went through the whole title transfer and all that.
Seems she would have more of a paper trail.
I think sometimes people can get caught up in the moment of the sale, and just not know what really going on. A slick seller can make it all seem exciting and take advantage of someone.

Patrick, you've help me in the past and I would like to kindly ask you for your assistance once again. My 2004 Prius (original owner) currently has 337,000 on the odometer and this past Monday, my car wouldn't start. Currently, my dash has the following symbols lit up:
    o Red Triangle,
    o Check Engine
    o Brake system warning light
    o ABS
    o VSC
o Slip Indicator Also on my navigation, the Hybrid system warning light icon is shown. Given the age and mileage of the vehicle, I would like to know what the issues may be and approximate cost. I was hoping to drive it until 400,000. Any advice would be highly appreciated. Thank you.

Get Mini VCI so you can retrieve the DTC.

Look for fluid turbulence in the inverter coolant reservoir.
