Got a ticket in Marin CA

    First, I disagree with giving 'green' cars HOV access, but California does. So one of these green cars not having all its stickers is attempting to be in compliance. A non-green car with a single person isn't attempting to comply. I'd rather the authorities enforce the law against the egregious violators before those complying with the spirit of the law.

    You know, I am on this site to share information concerning our fantastic vehicles. It is becoming increasing difficult to find information in most posts without running into discussions such as the one above. It is nice to read factual posts with information. It is not nice to read about people's opinions about politics and other worthless information that has absolutely no bearing on our automobiles. Hijacked posts is another major problem. I don't know what it takes to stay on topic but if we did and kept our opinions to ourselves it would would be a lot easier for people to find information because we would have half as many posts.

    Mr. Moderator, shouldn't this post be deleted so we can all get on with our happy lives?

    If you break the rules you pay the cost. What we'd "rather be done" has nothing to do with it. I actually think the officer showed wisdom letting Vern748 off with just a fix-it-ticket.

    Hi All,

    Update. Went to the CHP office this morning. Has all my paperwork with me, the same paperwork as the day I was pulled over. The CHP office looked at the ticket and it is NOT a fix-it ticket. I asked him to look at my vehicle and all the other information. He shook his head and appeared to be as gob smacked as I was. He indicated that he guessed that "Officer C" and I will have to meet in court.

    So, I am all about following the rules and laws. There is the law and then there is the spirit of the law. I am well within the spirit of the law. That said, the letter of the law does not specify the # of stickers, and the diagram is fairly ambiguous. I had 3 stickers. My 4th sticker fell off. The use of the stickers is to identify the vehicle as HOV compliant. A reasonable person, looking at the vehicle would clearly see that it is easily identifiable to be HOV compliant with the 3 stickers. The statute / law, indicates that the stickers are to easily identify the vehicle as HOV compliant.

    If you look at the attached photos, and as a reasonable person, think I am attempting to defeat the law, then so be it. My post is not to cry about it. My post is to let people know that this could also happen to you. Justly or unjustly.

    Since others may be impacted with this, my trip through the legal woos may be of interest. If there are not of interest to you, then please disregard any additional post I may add to this string.

    I think you now have the basis for your appeal. It looks like you met the letter of CVC 21655.9(b), and of VEH ยง 5205.5. The 4 sticker 'requirement' comes from some lower level rules or admin code.

    Is it your fault that the 4th sticker was attached, but blew off the car due to some inadequate surface preparation requirements that may have not been adequately disclosed to you? I'm not sure I'd volunteer the bit about aloe in the handiwipe until asked.

    Though beware, I am not a lawyer, and no one paid me for any advice.

    Then why are you reading this thread at all? There is already more such information on the site than any reasonable person can properly digest, without veering off into the many many many many threads like this.

    Police your own distractions. Let the site moderators police ours.

    And one day before that ruling, frodoz would presumably have defended a lynch if that was the law at the time because the law is the law, blah blah blah. And of course he would never take responsibility for the misery, torture and deaths his slavish devotion to authority lets flourish, or consider what other people must do to push society an inch further way from the reigning stupidities or horrors.

    When I read Frodoz I think of Fascism and Sharia, and understand a little better their origins.

    His comments remind me of a Jr. high vice-principal castigating students for violating the 'rule book' without the ability to apply common sense or look at why the rules are there.

    And to those who argue that the HOV lanes should only be for multiple occupants: They were originally introduced when concern for the use of fossil fuels was a major concern. Like the old double nickel 55MPH speed limit was meant to conserve fuel. Instead of just widening the freeway to accommodate increased traffic, they incorporated 'special' lanes that could only be used by certain classes of drivers.
    Most carpool users I see are not workers carpooling to work. I see moms with a car seat in the back. I see 2 guys with 2 surfboards on the roof (or in the back of a pickup). Or 2 adults and a child or 2 going to the beach. So the net result is upping the bang for the buck of transporting people using the least amount of fuel. it's about fuel, not occupancy. Something green cars to very well.
    And I'm not even going to mention (<---- a lie, I'm mentioning it) those who can afford a fast pass and be charged for avoiding the 'unwashed masses' on the non-special roadway. Kind of like airline first class, except we pay for the extra lanes through taxes.
    If you want a true HOV lane, then you should be able to form a group at work or school of folks who agree to ride together and be able to apply for a special placard that would hang on the mirror of the car that was shared that day. This would be a true carpool in the original meaning of the word.

    I'm sure I got a speeding ticket from an officer with my Prius one time simply because he was really happy to ticket a Prius.
    He even kind of joked about it being a Prius as he filled out my ticket.

    I really had the feeling he was especially looking for, and happy to ticket a Prius.

    Probably a game back at the office.

    I guess life out in Marin county is pretty quiet, HOV lanes notwithstanding.

    I like LEOs who do door kicks on felons, or at least write out police reports for real crimes.

    Like others on this forum I believe that HOV lanes ought to be used for what they're actually called but I know how it goes....I own two HOV compliant vehicles.

    I've never ridden in an HOV lane, because I'm fortunate enough to live where they are unnecessary, and I seldom travel to the nearest city that I'm familiar with that uses them (Nashville.)
    Fun fact:
    Nashville also has HOV stickers, but no LEO that I've ever talked with knows what they actually look like.

    I also agree that if one is going to be written a 'fake ticket' for violating some non-criminal statute, then they ought to REALLY be breaking the spirit of the statute instead of some unimportant technicality.

    I have a family member who is doing 20-to-life out on the left coast (imprisoned by work,) and so I keep in touch with life out there.
    I see fake stickers for sale on the internet, people using mannequins & baby seats, and other "scofflaws" who just do not give a rats using this lane.
    Having been deployed overseas twice with LEOs, my suspicions are that the Bureau of Eco Privileges, or whatever entity answers the numerous cellular complaints from aggrieved solo-HOV'ers (most probably while driving) just got sick of all of the complaints and singled the OP out for a little attention.

    I can hear the radio traffic now..... ;)

    Hi All,

    Here is an update.

    I did receive a letter from the CHP indicating that the ticket I received WAS a fix-it ticket. I took the ticket, the amended ticket, my "proof or HOV" form, to the CHP office. The CHP officer giggled, signed it and sent me on my way. I mailed in the ticket and all supporting information and my $25 fee.

    Lets see what the courts say.
