    my daughter was just reading an article that says humans are the first species to begin adapting to living indoors.

    I find it hard to stay indoors for days at a time.

    But out here that hardly ever happens.

    Just a couple of clouds in the sky and 73 F.

    Perfect weather for my sons soccer game(y).

    WRONG! It means my wife was found NOT AT FAULT as a result of the Investigation by the Florida Highway Patrol and the case is CLOSED. That is what is stated on the Florida Traffic Crash Report . We purchased a copy of it from the Florida Highway Safety & Motor Vehicles Traffic Crash Records Dept. Paid for to Our local Florida Highway Patrol and provided by them. The accident positively was investigated by the Florida Highway Patrol.

    So what do you do now? If I had a car that ran away I would have trouble ever trusting it.

    I had a Ford truck jump into reverse once. It almost killed me trying to stop it. I was a little gun shy after that happened.

    The FHP isn't the NTSB. They don't determine fault for accidents. They investigate whether laws have been broken in connection with an accident. They issue citations when there is probable cause to believe that a driver involved in an accident broke a law. The case then goes before a judge who determines whether the driver is guilty based on the testimony/evidence.

    Apparently FHP has determined that your car going over a parking barrier and down a steep embankment on private property didn't violate any laws, so they closed the investigation without charging your wife. If you think that the FHP has conclusively determined what/who is actually responsible for the accident (Prius defect versus pressing the wrong pedal), I think you may be mistaken, especially since Florida is a "no fault" state. They have merely found that there is not probable cause to believe that your wife violated any law, so the case is closed without her being charged.

    You may want to savor this "win." From the tone of this thread, it might be your only victory.

    Sorry should of said...Florida Highway Patrol decided to not FURTHER investigate.
    If they didn't obtain black box data, and there wasn't any witnesses, exactly what was the extent of their investigation? If they are saying it wasn't your wife's fault, who or what are they placing the blame?
    Are they saying it was unintended acceleration or mechanical failure?
    Florida Highway Police NOT charging your wife, and closing the case isn't proof of unintended acceleration.

    In another thread you posted that you had done some modifications to the brake pedal. Specifically so that you could "left foot brake"... I'm no expert and I'm no lawyer - but I am already suspecting this isn't anything to do with Toyota.

    That's an interesting statement.
    Without having read the article and being nearly totally ignorant, I'd say almost all animals just naturally live in dens, caves, and self created environments of protection. It's a cornerstone of evolution that animals seek environments of protection.

    So how do you define "Indoors"?
    Earliest evidence is caves.

    I would venture to say, the more correct statement is that humans were one of the first species to adapt the "indoors" to their living.

    Other animals live in caves, other animals don't paint pictures on the walls.

    i think the article was stating that we don't go out as much as we used to, and we're comfortable with that. much of our work and entertainment now takes place indoors

    As if the facts weren't difficult enough ("continuously observing" the brake pedal while plummeting down a "steep embankment") it seems that you have uncovered "the smoking gun."

    To borrow a phrase used earlier in this thread, CASE CLOSED.

    This is a titanium wider rally brake pedal to allow higher leverage in braking and to allow right foot, left foot and both foot braking. I installed this brake pedal after the report where the California high patrolman was killed along with his passengers in a runaway Toyota product vehicle accelerating wide open throttle and he couldn't apply enough pressure to stop the car. I addressed this concern early on and strongly insist that this is a safety feature for braking with the stated concerns. It allows right foot, left foot and both feet braking with little probability of feet slipping off this pedal and with the ability to apply higher pressure to the brake pedal. It positively works better and is more comfortable. We now have over 40K miles experience with this pedal and wouldn't choose to be without it.
