BRUSSELS, March 6 (Reuters) - The European Commission will start customs registration of Chinese electric vehicle (EV) imports on Thursday, meaning they could be hit by tariffs from that point if the EU's trade investigation later concludes that they are receiving unfair subsidies.
The Commission is carrying out an anti-subsidy investigation into Chinese battery EVs to determine whether to impose tariffs to protect EU producers. The probe is due to conclude by November, although the EU could impose provisional duties in July.

In a document published on Tuesday, the Commission said it had sufficient evidence tending to show Chinese EVs were being subsidised and that imports had increased by 14% year-on-year since the investigation was formally launched in October.
It said EU producers could suffer harm, which would be difficult to repair, if Chinese imports continued at this accelerated rate before the conclusion of the investigation.

The China Chamber of Commerce to the EU said that it was disappointed by the move and that the surge of imports reflected increasing European demand for electric vehicles.

Yeah not sure why they call it retroactive in the headline and provisional in the text.

The decision published on Thursday foresees differentiated duties, calculated according to the parent company, annual turnover and suspected amount of subsidies received. They will come on top of the existing 10% rate.

BYD: 17.4%

Geely: 19.9%

SAIC: 37.6%

Other BEV producers in China that cooperated in the investigation but have not been individually sampled, including Tesla and BMW: 20.8%

Other BEV producers in China that did not cooperate: 37.6%

The introduction of the measures will be, for the time being, provisional.

Retroactive or "ex post facto" laws are not allowed in the US Constitution and most other countries.

Tariffs are a two-edged sword-
for some their perspective is it protects jobs and industry-
for others their perspective is it artificially increases consumer cost and access to goods-
and then there are a wealth of others whose opinions are a mixed bag between these two views.

The EU and currently the US (within a certain political party) would both have an unhealthy alliance and undue influence from Labor Unions for better or worse depending on your view.

At one time the USA and Europe were Kings of Manufacturing Worldwide - now in many instances they cannot even compete in some areas of manufacturing.
