I call a guy like this a dumbf**k in a pickup truck and this is a classic example of why that label is so accurate. A 24-year old drunk driver in a Ford F350 was careening down the wrong side of the freeway at about 11:00 PM last night and collided head on with a minivan with a family inside. He killed five of the eight people inside, mostly children while only receiving minor injuries himself. He refused a blood alcohol test but a judge ordered it. The dumbf**k had a blood alcohol level of .25 which is more than thrice the legal limit. The newspaper article identified him as Michael Gagnon from Adrian, Michigan which is about 12 miles from Toledo.

Have a safe and Happy New Year. Don't drink and drive.

It is possible, though perhaps not probable that he can get the death penalty since it occurred in Ohio.

I call it attempted homicide just to be caught driving drunk. Why does someone have to die before before it is serious? Ohio is considered pretty tough on DUI, but a first offense is 3 days in jail and, unless someone dies, there is no way you can make anyone take a blood test. We will just take away their license for a year if they don't. Sure beats Agg. Vehicular Homicide.

    Stereotyping?????? Not at all.

Not stereotyping. If a drunk Prius driver killed someone else, I'd advocate having them spend the rest of their life in prison (I was about to say "behind bars" but that could be misinterpreted), too.

Everybody knows drunk driving kills. So if you drive drunk and kill someone, that is whatever the legal term for pre-planned homicide is, and should get the same punishment.

And taking the above, if you get caught drunk driving, the punishment should be the same as for attempted homicide.

    Yes.

I vote for something similar for drivers on cell phones.

At least send the sob off to Iraq for a few tours. If he survives, then put him in prison.

Nah. The medical care at Gitmo is too good for someone of his caliber.

He needs to be sent someplace far worse...someplace where he'll be reminded constantly of what he did and suffer mentally & emotionally as a result.

Saw this on the news tonight. It's sad that people drive while intoxicated. Just never learn do they? Any high speed accident thats head on with any vehicle is gonna be nasty.

He's been charged with five counts of aggravated vehicular manslaughter. I wonder how much time he's going to have to do for this. What's the difference between vehicular manslaughter and aggravated vehicular manslaughter?

aggravated anything makes the punishment more serious in my experience...

this guy deserved to die along with that family, at the very least. and in a far more painful manner that he could actually feel through the intoxication analgesia.

i dont think its stereotyping either. having a similar incident a few months back (sadly who doesnt have one in their area recently) here, its hard to keep one's emotions out of any conversation about these types of incidents.

i think he should spend a significant amount of time in jail. life?? no... 10 years minimum though. by then, his youth will be gone. hopefully, his recklessness as well

"Several people left flowers yesterday for 6½-year-old Stryker, the department's most experienced police dog, at a memorial for Oceanside officers who have died in the line of duty.

Stryker, a Belgian Malinois, died on the job about 7:20 p.m. Monday. A drunken-driving suspect whom Stryker had knocked down on the San Diego-Coronado Bridge picked up the 75-pound dog and leapt over the concrete barricade into San Diego Bay.
Cory Byron, 27, of Vista somehow survived the 200-foot drop, but Stryker did not.

Police say the driver headed south in his GMC pickup on Interstate 5, with Sadler, Carlsbad police and highway patrol officers in pursuit."

"Byron was arrested on suspicion of causing the death of a police dog, evading arrest and driving under the influence of alcohol, the spokeswoman said."

Now, the law considers Stryker property, so I say sue the for the total cost of the loss. Fully trained policedogs are not cheap. I hope they sue his sorry redneck nice person for the cost of replacing the dog. You don't just go to the pound and pick up another dog. We're talking a pure bred dog that has gone through training and has 6 years experience. We're talking 6 figures. I hope they take him for everything he has and garnish any future earnings he may have after his serves the maximum prison sentence they can throw at him.

I have NO sympathy for drunk drivers. They know exactly what they're doing when they decide to take that first drink. If you can't have fun at a party without getting drunk there is something seriuosly wrong with you that getting drunk will not solve. Take a cab to and from OR get a friend to drive you to and from. Once you decide to drive anywhere...YOU DON'T DRINK. How hard is this? I do it. I have no moral or religious reasons preventing me from drinking. I've enjoyed drinking in the past. BUT I've never been drunk and I've NEVER driven. I simply do not mix the two. If I drive I don't drink.

Let's face it. Nothing is effective against these morons. Taking away their licenses is useless. Taking away their cars is useless. They'll still find a way to drink and drive.

I'm for setting up a pillory in front of the DMV. Every Friday at noon, tie them up and flog them. One by one. Do it at lunch for the ridicule and enjoyment of spectators. Let that be a warning to anyone that thinks they can hold their liquor and still drive. Put it on the news every Friday night right before Sports.

Enough with killing children. Enough with killing innocent, law abiding people minding their own business and driving safely home within the speed limit and within the law.

We can't flog them? Well, then let's stop enabling the stupidity. Call it what it is: premeditated murder and lock them up for the max. They may never admit their responsibility but at least they'll be sober and off the road.

"Mr. Gagnon was believed to have been partying at the Rodeo Bar and Grill, a country music bar that shares a parking lot with the Holiday Inn Express at 3154 Navarre Ave.

Christine Shallal, general manager at the Holiday Inn, said three rooms were registered to Mr. Gagnon and his family for Sunday night. A manager and waitress at Rodeo Bar declined comment."

"Earlier yesterday Samuel Gagnon (brother) told the Baltimore Sun that his brother, wasn't supposed to be driving, but left the Oregon bar they were partying at without warning. He was driving Samuel Gagnon's truck."

So, how did he get the brother's car keys?

He had a room at the hotel. He didn't have to drive at all.

"Chief Spann said Mr. Gagnon was aware the accident caused the deaths, and was uncooperative and belligerent when he spoke with investigators."

    "
Mr. Gagnon also admitted to consuming intoxicants, and one or more liquor containers were found in his vehicle, according to the warrant."

    property damage sure.

but also attempted manslaughter, endangering the public, taking a motor vehicle without permission (vehicle owner does not prosecute, then charge him with lying to a police officer and aiding and abetting...) jaywalking, fleeing and eluding, speeding, and run then all consecutive...

who cares about the money?... his family should not be punished for what he probably did on his own although i dont believe a word of what his brother said. after all, what would he say?? "sure i let him drive!. he looked ok to me!"" so he of course would lie...

i think a lifetime breaking rocks and playing bottom will be good enough

Why was the bolding of 'GMC pickup' necessary?

No mercy for this POS drunk driver- send him/her to prison for at least 5 years for each death to run consecutive! Then liquidate everything they own and give it to the survivors. Finally, cell them up with Bubba.
