Owned my prius less than 90 days and in an accident

    State of Washington. He did a phone consult with an attorney after doing some research on the net. Attorney told him to stick it out and not budge. His car had a clean carfax before the accident and had some pretty significant damage after. Not enough to total it but front and rear damage. It took a while to get all of the insurance companies sorted out. The original at fault insured ran out of money and his company ended up paying for it.

    Hey, it's always about the money.

    Even, if either insurance company won't front it, I'd rent an equivalent car on my own. That mean's the clock and the costs for settlement will add up as time goes by.


    They realize that the longer that the diddle and doddle, the more it will eventually cost them.

    I believe gap insurance is for accidents where you are at fault. If someone is at fault then their insurance will pay you dont have to worry about gap coverage. unless they are not insured. that is how it works in oregon

    Gap coverage pertains to a totaled vehicle where the insurance company pays less than you owe. I do not owe more than I would be given in the event it is totaled (which I'm hoping for).

    Here is a picture from the scene, the at fault driver began losing control at the double white lines leaving the intersection coming towards the camera, my car was impacted in the area of the first bit of debris closest to the camera on the shoulder.

    It's just amazing that as wide as that road is, you both managed to make contact. What was she doing?

    The adjuster will be looking at the car this afternoon. I will try to post a picture of a diagram I wrote up that details the accident. She was rushing to make the red light driving a Mustang GT, got right around the double white lines that go across the road, back end slipped out, she kept trying to regain control but every time she did she over corrected and threw it into a uncontrolled drift in the opposite direction, she ended up drifting across both oncoming lanes (my lane) and hitting be on the shoulder. I contacted a lawyer this morning to see if there is any case to be made. As much as I hate to be a cry baby (because I usually dislike people like that) my neck and back has been pretty stiff since last night (accident happened Wednesday) but I have a preexisting disability claim pending with the Department of Veterans Affairs for back problems from my military service.

    I'm the vehicle on the right... The guys at work have a theory that she had been watching too much Tokyo Drift.

    I would not post any diagrams and hold off saying too much (more) on this forum until you get this done with...just my .02

    regardless of the VA claim, did you go to the hospital? Doctor?...if not GO NOW. Dont think into it too much, you are not a Doctor..anything that happened apparently made your condition WORSE...that is what matters...keep it simple, tell the Doc what only happened in this incident and let them tell you what condition you are in...you are not a "cry baby" if someone blasts across a road and smacks your car..and you are HURT...

    This may come back to you in ten years...

    Hope she gets nailed for careless or reckless driving. She deserves to pay for risking peoples lives with her poor driving.

    I wish it were so simple, I only have VA health insurance so I can't just call up and go in for an appointment today or something, and if I go somewhere else I am going to be paying out of pocket. I already have an appointment in November for something else so I was just going to talk to them then. I might mention it to the claim "handler" when I talk to her this afternoon that I would like to see a doctor as stiffness has started.

    Emergency room I believe VA pays for that..worth checking out...

    Do you both have the same insurance company? If not, then I thought they should be doing the talking?...not sur eabout that tho...did the lawyer take your case pro-bono?

    We do not have the same insurance, I am dealing with her company for now. And the lawyer hasn't taken the case yet just a consultation to see if I should be pursuing legal action.
