    Interesting, none of the women who paid for these abortions is on trial for first degree murder . . . or any murder. Typically all parties to a crime are at least charged and some get to plead to a lessor charge. But I haven't seen any indication that these co-conspirators have faced any criminal prosecutions.

    In the charges of a late abortion, the primary source would be the woman's report of when the pregnancy started. Determination of the exact age of a fetus is at best an art, not a exact science.

    What is really interesting is the legal theory that the aborted fetus has the rights of citizen. Interesting because many years ago, there was failed execution, Georgia I believe. The electric chair failed to kill the condemned man. So he appealed that a second execution was 'cruel and unusual.' He lost the appeal and died in the second execution.

    So here we have a procedure that ends the fetus. That is the objective of the procedure. So can an accidental or medical malpractice failure lead to a sustainable, first degree murder conviction?

    This issue alone will be more than enough to carry it up to the Supreme Court.

    The second, more interesting observation are the 'trap laws' that attempt to close down only abortion clinics. Again, it needs to head to the Supreme Court to determine if these should be applied to all clinics whether or not they provide abortions. A fairly simple ruling could instantly nullify these efforts to legislate the war on women.

    In this case, the fact that an abortion results in the destruction of the fetus is enough to stop a lot of nonsense. Then a ruling on clinic 'trap laws' and the problem is 90% solved.
