You can sue, but you won't win.

Yes it is illegal to overload, and yes it is commonly done.

Perhaps because people in this country are litigious self-centered A-holes who take no responsibility for their own actions. ;)

I stand corrected. As others have said, the maximum rated load (aka GVWR) is indeed passengers + cargo.

My guess is the auction factor--you MIGHT get more than your "buy it now" price. Also, perhaps, that listings on eBay are seen everywhere and on Craigslist--doesn't it depend on the area you choose to look at? I know I only see LA automatically, and I'd have to select other areas and look at them separately. Who knows where someone might be willing to travel...?

    I like that...LOL.

Anyway, the reason I put it on EBAY is that I can follow up with it on my iphone, I also put it on craigslist, by the way, I think one of the factors that made the dealer pay that much was that in 2 hours the reserve was mt and the buy now was gone, I had the reserve set on $30500 and the buy now set at $32900. I told the dealer that I will have it on EBAY and it was funny that I got the call from him less that 5 minutes after it hit the reserve...LOL.

Consumer Reports has a table which includes the maximum load for MANY vehicles at Exterior & Cargo - Consumer Reports. Hopefully you can see this w/o a subscription.

If you can't see it, here are some max load figures:
    Acura TL: 850 lbs.
Chevy Malibu 4 cylinder: 915 lbs.
    Chrysler 300 Touring V6 and 300C V8: 865 lbs.
    Lexus LS: 825 lbs.
    Nissan Altima sedans (2.5L 4, 3.5L V6, hybrid): 900 lbs.
    Saturn Vue: 915 lbs.
Toyota Camry LE 4-cyl and XLE V6: 900 lbs.
    Toyota Corolla LE: 825 lbs.
