Just have your lawyer demand the fob or payment for it...it is your property and if she won't I'm quite sure the court would be happy to make things very difficult for her.
If I purchase a replacement FOB can the dealer program the two so that hers is no longer functional? Yes. You need to tell him specifically to delete it. One dealer said that just by programming the new FOB to work along with the old one, her FOB will be automatically "kicked out of service" He's wrong. as only 2 of the possible 5 FOBS allowed can be activated at once. I have three active fobs. This sounds highly suspicious. Hard to say if he's lying or just ignorant. What do I need to do to keep her out? Change the fobs AND the mechanical key. She needs the fob to start the car, but only the mechanical key to open the door. I don't know if you can set it to alarm if the door is unlocked and opened while the fob is absent.
I take it you didn't read the part where se swears she "lost it " and was judged to be "unreasonably cruel". There is no dealing with her. I wish I could. Anyone know a dealership in texas that does it cheaper than $250?
I wonder if that can be changed manually since now the mechanical key isn't one of those fancy coded keys. It's sole mission is to lock and unlock the door like a regular lock so presumably a run-of-the-mill locksmith should be able to change the key and lock. You just have to figure out how to remove the lock from the door.
Check out Prius door lock . Rather than disassembling everything, you could just purchase a new lock cylinder (includes 2 keys) and install it yourself. The price I remember was something like $40-$50.

Like Judge Judy said " Get over it and move on with your live"' If I were you I will paid to have a new FOB and program out the "lost one" and also have the doors re-keyed. A few hundred dollars will get you much more happiness.
Of course, if she's "unusually cruel" she doesn't actually need a key to get into your car...any brick will do as well.
Nooo ... you DON'T want to have Mr. Billable hours to get involved. This will instantly become a $200 used FOB (1/2 hour minimum billed). One of my law school buddies does family law. He has NO issue pleading any dumb thing that his customer wants him/her to plead ... as long as the community assets haven't run dry. Nevermind that the smart key also contains a "manual" key....yeah....but no, lets just jump straight to blaming the technology.
Lighten up. I'm not blaming the technology. But with any technology you usually have more complication and more cost. I know people love the Smart Key System. But you have to admit, in a situation like this...it would be much easier if you were dealing with a straight set of "stupid" keys. I think the OP is aware that the smart key also has a manual key...and that's part of the problem..."EX WIfe Still has FOB!". Title of the thread. I think push button starts..and smart key systems are the technology not only of today but it will trickle down to all levels of automobiles soon... I'm not knocking the technology...but with any advancements there are trade offs. Once we had the telegraph...you didn't get to ride the ponies across the plains anymore...
